In the filing, Wendy’s claims that Wells Fargo is in “possession of several million dollars in funds”, belonging to the ailing host, and that it has been denied access to its funds for more than two weeks.

Her lawyer alleged that Wendy’s former financial adviser informed the bank that Wendy “was not of sound mind” and that Wells Fargo denied her access to her bank accounts and statements.

Wells Fargo justified its decision to keep Wendy’s accounts frozen by referring to its authority, under various agreements with its customers, to “‘suspend or reject instructions for a proposed transaction,’ pending legal remedies. or administrative, if they suspect financial abuse, insanity, or undue influence,” the petition demanded.

The host’s legal team says the bank exceeded its authority, in part because Wendy did not offer any transactions that should give the bank discretion to suspend or deny access to accounts.

His attorney is seeking court orders allowing him “access to his financial accounts, assets and statements,” while his dispute with Wells Fargo is resolved through arbitration.

The petition alleged that Wells Fargo breached its fiduciary duty and that the host suffered “imminent and irreparable financial harm.”

The host team is asking the bank to provide access to Wendy and “its agents, members, officers, employees, representatives and any other person acting on behalf of the respondent” within 48 hours.
